Terms of Service

Welcome to Pont. These Terms of Service (the “Terms”) are a binding agreement between you and Pont (“Pont,” “we,” “us,” or “our”) governing your access to and use of the Pont macOS application, our website at pont-app.com, and related services (together, the “Service”). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract to use the Service. By using Pont, you represent that you meet these requirements and are not prohibited from using the Service under any applicable law.
2. Your account
Some features require an account. You are responsible for the information you provide, for keeping your credentials secure, and for all activity that happens under your account. Let us know promptly at help@pont-app.com if you suspect any unauthorized use.
3. The Service
Pont is a macOS assistant that listens to a conversation (via your microphone and, with your permission, system audio) and can read screenshots you choose to capture, in order to generate real-time suggestions shown in a private overlay on your device. Speech is transcribed and, together with any captured text, may be sent to third-party AI providers to produce responses. The Service depends on your device, your network, and those providers, and its features may change over time.
4. Recording, consent, and lawful use
You are solely responsible for using Pont in compliance with every law and rule that applies to you and to the conversations you use it with. Many jurisdictions require the consent of some or all participants before a conversation is recorded, transcribed, or monitored. You are responsible for obtaining any consent that is required and for honoring any policies or agreements that apply to you — including exam, certification, interview, or employer rules. Do not use Pont where its use is prohibited.
5. Acceptable use
You agree not to:
- use the Service to break the law or to infringe the rights of others;
- use the Service where doing so violates rules or agreements you are bound by (for example, an exam, certification, or employer policy that prohibits assistance);
- record or capture people without any consent required by law;
- reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service or its systems;
- resell, sublicense, or commercially exploit the Service without our permission; or
- use the Service to build a competing product or to train a competing model.
6. Plans, billing, and refunds
Pont may offer free and paid plans. If you buy a paid plan, you authorize us and our payment processor to charge the applicable fees and any taxes. Paid subscriptions renew automatically for the same period unless you cancel before the renewal date; you can cancel any time and keep access through the end of the current period. Except where required by law, fees are non-refundable. We may change prices going forward with notice.
7. Third-party services
The Service relies on third parties, including AI providers such as OpenAI and Google. When you use features that depend on them, the relevant content is processed by those providers under their own terms and policies, and we are not responsible for their services. If you supply your own API keys, you are responsible for your use of those third-party accounts.
8. Intellectual property
The Service — including the app, website, and their content, design, and software — is owned by Pont and its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms. All rights not expressly granted are reserved.
9. Your content
You keep ownership of the content you provide or capture through the Service (“Your Content”). You grant us a limited license to process Your Content solely to operate and improve the Service as described in our Privacy Policy. You are responsible for Your Content and for having the rights needed to use it with the Service.
10. Feedback
If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose, with no obligation to you.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Pont uses automated systems and AI, which can be inaccurate, incomplete, or unsuitable for your situation. You are responsible for how you use any output. We do not warrant that the Service will be uninterrupted, secure, or error-free.
12. Limitation of liability
To the maximum extent permitted by law, Pont and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunities, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim or USD 100.
13. Indemnification
You agree to indemnify and hold harmless Pont and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or end your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know, such as posting the updated Terms with a new “Last updated” date. Your continued use of the Service after the changes take effect means you accept the revised Terms.
16. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory laws where you live apply to you. Nothing in these Terms limits any non-waivable rights you have under your local law.
